The sinful person will be given a different type of body for suffering.It is called Yatana Sarira.The suffering is 100 times more when compared to the normal body.He will be put into many horrible punishments but the body doesnt die until he completes all his punishments in hell.After this he will agian has to come back to earth and take a body according to his karma.
But for those who lead a devotional life the yama dutas can not even approach them.The devotees are being sinless will never go to hell.

Srimad Bagavatam 6.3.29 — My dear servants, please bring to me only those sinful persons who do not use their tongues to chant the holy name and qualities of Kṛṣṇa, whose hearts do not remember the lotus feet of Kṛṣṇa even once, and whose heads do not bow down even once before Lord Kṛṣṇa. Send me those who do not perform their duties toward Viṣṇu, which are the only duties in human life. Please bring me all such fools and rascals.
So,a intelligent person must chant hare Krishna and make his life successful.

When soul leave this gross body then subtal body remain with soul and after leaving this gross body Yamduts give another body to the soul and with this new body soul start his journey towards yampuri.
It is explain in Vedic scriptures that this new body is design in such way that, soul suffer a lot but can't escape from it.
This new body is ment for suffering.........

The subtle body remains after the death, therefore atma usually do not become completely free.

Dandavt pranam what is subtle body and what is called ghost or spirit???
The living entity acts in a gross body in this life. This body is forced to act by the subtle body, composed of mind, intelligence and ego. After the gross body is lost, the subtle body is still there to enjoy or suffer. Thus there is no change.
Ghost is living being without gross body.
